Driving under the influence is a criminal act in Canada. There are a few different types of charges related to driving while under the influence of drugs and/or alcohol. Over 80 charges refer to individuals that are operating a motor vehicle while above the legal blood-alcohol limit.
Separately, an individual can be charged with Impaired Driving, this crime involves driving while below the legal BAC limit, but still unable to safely operate a motor vehicle due to the influence of alcohol or drugs. Police cannot arrest a person for BOTH offenses – it’s one or the other.
Additionally, unsafe drivers can face Dangerous Driving charges if they are driving in a manner that could potentially be harmful to the public or private property.
