Domestic Assaults

Domestic Assaults

A domestic assault involves an altercation between a couple that escalates to the point of physical harm and/or verbal threats.

When domestic assault occurs, the victim contacts police and, regardless of what the accused claims, police are required place the accused under arrest.

It is worth noting that under Canadian law, even a simple slap of on the wrist, for example, can lead to charges being filed.

Possible Charges and Maximum Sentences

  • Domestic Assault carries a minimum sentence of two years should the value of the subject-matter exceed $1,000,000 (less than 2 years if the value is < $1 million)
  • Domestic Assault carries a maximum 14-year sentence depending on the severity of the crime.
